  • Business Interruption Covid-19 Claims

The Supreme Court has substantially allowed the FCA’s appeal on behalf of policyholders to bridge the gaps that were left from the earlier Court decision and will result in thousands of policyholders being able to secure payment under their insurance policies.

The key findings were that cover should be provided in respect of disease clauses and certain prevention of access clauses including a partial closure of businesses,  as the pandemic and the Government and public response caused the business interruption losses.

Michael has a wealth of experience spreading over 30 years in the legal profession (with time out as a traveling storyteller and Talmudical student).

He enjoys a reputation as a determined fighter who has taken cases that other lawyers have turned down and turned them into success.

Michael’s great strength is the ability to think laterally outside the box.  He is greatly supported by a growing team of sharp-minded professionals who share his enthusiasm for doing a job well.

Robert Askey

 was admitted as a Solicitor in 1988 and practiced as such for the next decade, working variously in the fields of Commercial Property, Commercial Litigation, Personal Injury, Housing, Crime, and Data Protection. He was Head of Civil Litigation at a noted Legal Aid firm on Merseyside and handled complex Finance Litigation and Insolvency matters for international banks with Messrs Bermans in Liverpool and London.

Then in 1998 with a transfer to the independent Bar (Called by Lincoln’s Inn July 1998), he began a new phase of his legal career. Initially based in Chambers in Liverpool his practice included Prosecution and Defence work in Crime, including complex Fraud, Commercial Chancery work including Landlord & Tenant, Finance matters and Insolvency and in P.I., High-Value claims for historic Sexual Abuse. A separate arm of his practice involved Public Law work and Employment Law, especially Discrimination claims. For some years Robert also practiced from Cornwall Street Chambers in Birmingham, attached to its Media Law Group. Robert holds a Bachelors’s Degree in Film-making from S.F.I. in Seattle, USA.

In 2005 Robert set up and established his own Set of Chambers and practiced from there, being Head of Chambers for some years, maintaining the same fields of work. Latterly Robert joined Elite Chambers in the Spring of 2020, practicing as In-House Counsel in various fields including Commercial Chancery and Property.
